Contract Advice and Dispute Resolution

Forms of procurement are constantly evolving
together with their associated Contracts. Advice on the most
appropriate form of Contract early in the procurement process will
potentially deliver to the client, commercial and programme
benefits whilst reducing opportunities for conflict between the
parties should contractual disputes arise, it is in the interests
of both parties to avoid lengthy and costly legal action, our
expert advice on dispute resolution can help to achieve this.
We provide
expert advice on contracts, procurement strategy, risk transfer,
contract document preparation, contract administration and
specific formal expert statements and reports, acting as expert
witness. We cover all forms of dispute resolution, including
mediation, conciliation, adjudication, arbitration and
litigation.
Procurement
of transport infrastructure schemes from minor road junction
improvements to new motorway schemes for UK and international
clients. The appropriate form of contract will vary according to
the infrastructure owner. We have implemented schemes using all
forms of Contract including traditional remeasurement, Design &
Build, Design Build Finance and Operate (DBFO) and
ECC/partnering/Early Contractor Involvement.
Our knowledge has led to us advising clients
on the most effective form of procurement and has enabled us to act
as expert witness and to assist in resolving contractual claims and
disputes. In UK we have advised the main National Road Authorities
on developing forms of contract.
SW staff co-authored the UK ICE Arbitration
Procedure 1997 and are also on the ICE Arbitration Advisory Panel.
Scott Wilson is experienced in alternative dispute resolution and
is represented on the lists of Arbitrators, Adjudicators,
Conciliators and Dispute Board Members maintained by ICE, CIArb,
FIDIC. We have experience of resolving disputes by mediation,
conciliation and the adjudication processes. We have acted as
Conciliator in major claims and as Adjudicator on one of the
largest disputes referred to adjudication in the UK.
